1. Booking Confirmation and Payment Terms
a. A booking is considered as confirmed after Avatar Studios receives cleared balance payment or min 50% deposit
b. Clients must make the balance payment in full (including any agreed security deposit) immediately after the scheduled booking time, and failure to do so will result in non refund of advance payment without notice.
2. Booking times
Booking time starts as confirmed by the client. In the case of arriving later than the scheduled time, the booking charges will be considered from the time of schedule requested by the client at the time of booking.
3. Set Up and Take down time
The set up and take down/clean up time are scheduled within the booking hours. It is recommended to follow the schedule to avoid overtime charges.
4. Cleaning & leaving the studio in reasonable state
a. The client must note that the Studio or rented space must be left in reasonable state at the end of the shoot/event to avoid additional cleaning charges (at discretion of Avatar Studios).
b. For events and large shoots with 5+ people, we have a standard cleaning charge of 5% of the cost (or rate to be agreed prior to booking depending on size, nature and the space booked).
Note: The cleaning charge is based on leaving the space in reasonable state. Any additional cleaning charges may be taken out of security deposit payments.
5. Number of Attendees.
a. The rates incurred are inclusive of the number of attendees involved. The number of attendees must be communicated and agreed upon at the time of booking the rental space. Any increase in the number of attendees may incur relevant additional charges.
b. Avatar studios have all the rights to refuse entry or terminate the booking in the case where the venue exceeds the maximum capacity. The maximum capacity of attendees for a particular space must be advised to the client prior to the bookings to avoid unforeseen circumstances.
6. Security Deposit
a. For space and equipment hire, there will be a Holding/Security Deposit of (which will be agreed prior to booking depending on size, nature and space/equipment being booked). The security deposit will be returned at the end of the booking (minus any deductions due to damage, additional cleaning fee, additional attendees or overtime, if any).
b. Security deposits will be held as security against breach of terms. Any breach of the aforesaid terms and conditions by the client will result in non refund of the security deposits.
7. Minors
It is mandatory that all minors under the age of 18 are accompanied by a chaperone. Clients must ensure that the Minors have parent's or guardian’s permission to be at the premises, and/or to be photographed or filmed as relevant.
8. Use of Equipment
a. Bookings with additional accessories such as lighting, sound or any other equipment must be returned promptly in its original condition at the end of the hire period. Any damages or missing equipment will incur repair and replacement charges.
b. Clients may not without the written consent of Avatar Studios; remove, modify or alter any equipment or accessories from the studio premises.
Any modification, alteration without prior consent or tampering with the equipment and accessories or the use of equipment in a manner not recommended by the manufacturer or allowing untrained or unauthorised personnel to use the equipment will be considered as breach of terms and conditions resulting in the loss of security deposit if any and termination of scheduled booking
c. Any required equipment, prop or add-ons must be requested and added to booking charges in advance to ensure availability of the same. Avatar Studios cannot guarantee the availability of any equipment or prop which has not been specifically requested and confirmed at the time of booking the space.
9. Breakages, Losses and Damages
a. Clients are responsible for any breakages, losses or damages caused to the premises or equipment by the client, or any other person(s) during booking time.
b. All equipment used is at the risk of the client and Avatar Studios shall not be liable to the client for any loss, damage, expense, or for any consequential loss (including loss of profit) arising out of or in connection with; any damage to or loss of property by the client or third party; any breakdown, stoppage or failure of the facilities/equipment provided by Avatar Studios.
c. Alterations or an addition to our premises or equipment is not permitted without prior written consent.
d. Clients must check any equipment provided and must notify Avatar Studios at the time of supply. If any equipment is damaged or if the condition of the equipment is not acceptable. The client is responsible for any breakages or damage in case of failing to notify at the time of supply.
10. Booking Changes and Cancellations
a. Studio hire booking times can be changed with RE-BOOKING FEES as stated below, which depend on notice time provided:
• 7 days (168 hours) or more notice time provided (from start time of booking): Rebooking fee equal to 10% of total booking fee.
• Less than 7 days and more than 3 days (168 hours to 72 hours) notice time provided (from start time of booking): Rebooking fee equal to 25% of total booking fee.
• Less than 3 days (72 hours) notice time provided (from start time of booking): Rebooking fee equal to 50% of total booking fee.
b. Studio hire bookings can be cancelled with CANCELLATION FEES as stated below, which depend on notice time provided:
• 7 days (168 hours) or more notice time provided (from start time of booking): Cancellation fee equal to 25% of total booking fee.
• Less than 7 days and more than 3 days (168 hours to 72 hours) notice time provided (from start time of booking): Cancellation fee equal to 50% of total booking fee.
• Less than 3 days (72 hours) notice time provided (from start time of booking): Cancellation fee equal to 100% of total booking fee.
11. Termination
Avatar Studios may terminate any booking or hire contract if the client is found to be in breach of any of the terms and conditions.
12. Noise
a. Speakers are provided and Music can be played inside premises at a moderate and reasonable (at discretion of Avatar Studios). Noise levels outside the premises must be kept to a reasonable level during bookings. Clients are asked to consider other occupants and neighbour residents when using the facilities.
b. Music must be turned off by 10 pm and noise levels must be minimised to a low and reasonable level after this time in order to not disrupt or cause inconvenience to nearby neighbours.
13. Littering and Waste Disposal.
Clients must not litter and drop waste on the inside or outside the premises. The client must ensure that all the litter is put in internal bins or in specified garbage and recycling bins which are located outside of the premises. Additional bin bags will be provided and clients are responsible for ensuring all waste is disposed off and outside spaces are kept clean and litter free. Failing which will result in additional charges.
14. Non-Solicitation
Clients will not directly, indirectly, or on behalf of others; solicit, induce, recruit, encourage or otherwise endeavour to cause or attempt to cause any employee, previous employee or consultant of Avatar Studios to perform any business/services to the Client, or to terminate their relationship with Avatar Studios.
15. Variations
The above Terms and Conditions are valid at time of booking and are subject to variation. Clients will be notified of any variations prior to booking.
16. Applicable Law
The agreement shall be governed by and construed in accordance with Indian law and the parties hereby agree to submit to the non-exclusive jurisdiction of the Indian courts within the Bengaluru District, State of Karnataka, India.
